Terms of Service

SudoMock is a software service operated as a registered DBA (Doing Business As) under a New Mexico limited liability company, with its principal office at 1209 MOUNTAIN ROAD PL NE, STE N, ALBUQUERQUE, NM 87110, USA. References to "SudoMock", "we", "us", or "our" in these Terms refer to the operating entity. For legal inquiries regarding the parent company, please contact [email protected].

1. Agreement to Terms

By accessing or using SudoMock ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

SudoMock provides a mockup automation infrastructure for generating product mockups from PSD (Photoshop Document) files. The Service includes:

  • PSD file processing and analysis
  • Smart object detection and manipulation
  • Mockup rendering and image generation
  • REST API access for programmatic integration
  • Dashboard for visual mockup creation (rendering in the dashboard does not consume credits)
  • Automation integrations (n8n, Zapier, Make)
  • Native e-commerce integrations (Shopify, WooCommerce)
  • Embeddable customer-facing customization studio

3. User Accounts

To use the Service, you must:

  • Create an account with accurate and complete information
  • Maintain the security of your account credentials and API keys
  • Notify us immediately of any unauthorized access
  • Be at least 18 years old or have parental consent
  • Not be located in, or a resident of, any country or region subject to comprehensive U.S. sanctions (currently including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine), or be on any U.S. government restricted-party list

4. API Usage and Credit System

  • Dashboard Usage: Rendering in the dashboard does not consume credits. Preparing a reusable mockup from a product photo is the one exception and is charged once, at the rate published on our pricing page
  • API Credits: Each render consumes 1 credit. Credits are purchased in fixed packs (5K, 10K, 25K, 50K, 100K) tied to your subscription tier
  • Parallel Renders: Maximum simultaneous render requests allowed per plan tier
  • Parallel Uploads: Maximum simultaneous upload requests allowed per plan tier
  • Fair Use: We reserve the right to throttle or suspend accounts that abuse the Service
  • Service Optimization: Technical parameters may be adjusted without prior notice to ensure service quality
  • API Versioning: We will provide at least 90 days written notice via email before deprecating or introducing breaking changes to any public API endpoint

5. Payment Terms

5.1 Subscriptions

Paid subscriptions are billed monthly or annually in advance through Stripe. By subscribing, you authorize SudoMock to charge your payment method automatically at the beginning of each billing period until cancellation.

  • Annual billing is charged at ten times the monthly price, which is effectively two months free (approximately 17% savings)
  • Subscriptions renew automatically unless cancelled before the end of the current billing period
  • Price changes will be communicated via email at least 30 days in advance
  • All prices displayed are net prices, exclusive of applicable taxes

5.2 Credits and Capacity Reservation

Credits are a prepaid allocation tied to each billing period. We reserve capacity for your account at the start of the period, so credits are used on a use-it-or-lose-it basis within that period. Accordingly:

  • Unused credits do not roll over between billing periods
  • Credits are not transferable between accounts
  • Credits are not redeemable for cash
  • Subscription fees and credit purchases are non-refundable except as expressly provided in our Refund Policy

5.3 No Surprise Overages

When you exceed your monthly credit allocation, render requests are paused. We do not charge you for additional credits unless you have turned on automatic top-up yourself. Automatic top-up is off by default.

If you turn automatic top-up on, you choose a balance threshold and a top-up amount. When your prepaid balance falls below the threshold you set, we charge the payment method saved on your account for the amount you set and add it to your balance. The top-up amount must be at least the threshold, so that a single top-up clears it. You can change these settings or turn automatic top-up off at any time from your dashboard, and turning it off stops any further automatic charge.

If automatic top-up is off, you may continue rendering by adding to your prepaid balance, by moving to a higher plan, or by waiting for the next billing period.

5.4 Failed Payments

If a payment fails, we will retry the charge over fourteen (14) days and notify you via email. If unresolved, your subscription ends and the credits included with that subscription expire. Your account then continues under Section 5.6. Any prepaid balance you hold is unaffected and remains yours.

5.5 Refunds

Refund eligibility is governed exclusively by our Refund Policy.

5.6 Prepaid Balance

Prepaid balance is money you add to your account in advance. It is separate from the credits included with a subscription, and the use-it-or-lose-it rule in Section 5.2 does not apply to it. Rendering draws from your balance as the work is performed, at the rate that applies to your account. A minimum and a maximum apply to each addition to your balance, and both are shown to you before you pay.

Your balance cannot go below zero. If your balance is not sufficient for a request, the request is refused rather than performed on credit. You do not build up a debt to us through rendering, and no unpaid amount is carried forward to a later period.

Your account is treated as funded while any one of the following is true: you hold an active paid subscription, your prepaid balance is above zero, or you completed a top-up within the previous ninety (90) days. While your account is funded, renders are delivered without a watermark and without the output width cap, and the storage and concurrency limits applicable to your account apply.

If none of those is true, your account is not funded. You may still use the Service. Renders remain faithful to your source file, but they carry a watermark, output width is capped, and lower storage and concurrency limits apply. Adding to your balance removes those limits again.

5.7 Chargebacks

If you dispute a charge with your bank, the disputed amount is returned to you and is removed from your prepaid balance. Credits held on your account are cleared at the same time. Your account stops being treated as funded, so the limits described in Section 5.6 apply again, and automatic top-up stops. If you believe something was cleared in error, contact us and we will review it.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction, including export control and sanctions regulations
  • Infringe on intellectual property rights of any third party
  • Upload content that is defamatory, obscene, harassing, or promotes violence
  • Attempt to reverse engineer, decompile, or compromise the Service
  • Use automated systems to abuse parallel limits or circumvent rate limiting
  • Share API keys with unauthorized parties or resell Service access without a written agreement
  • Upload malicious content, malware, or code designed to harm the Service

7. Intellectual Property

The Service and its original content, features, and functionality are owned by SudoMock and are protected by international copyright, trademark, and other intellectual property laws.

You retain full ownership of content you upload. By using the Service, you grant us a limited, worldwide, non-exclusive license to process your content solely for the purpose of providing the Service. We do not claim any rights to your mockups, PSDs, or rendered outputs.

8. Beta Features

Beta, preview, or experimental features are provided "AS IS" without any service level commitments, are subject to change or removal without notice, and are not covered by any uptime or performance guarantees.

9. Liability Limitations

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total aggregate liability shall not exceed the amount you paid to SudoMock in the twelve (12) months preceding the claim
  • We target 99.9% uptime but do not guarantee uninterrupted service

10. Indemnification

You agree to indemnify, defend, and hold harmless SudoMock and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) any content you upload to the Service.

11. Termination

We may terminate or suspend your account immediately, without prior notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees
  • Extended periods of inactivity (12 consecutive months or more)

You may cancel your account at any time through your dashboard or by contacting [email protected].

12. Data Retention After Termination

  • Cancelling does not delete your account. You can ask us to reactivate it at any time
  • You can ask us to delete your account data at any time, and we will. Billing and payment records are kept, as tax and accounting law requires
  • Uploaded PSD templates on unfunded accounts may be removed after a period of inactivity. A template that has gone 7 days without a render enters a warning sequence and may be removed about 13 days after its last render. Rendering a template keeps it active, and warning emails are sent first
  • Rendered images are deleted 7 days after they are produced. Video outputs are not on that schedule
  • Design files attached to an order are kept for fulfillment and are not deleted on a schedule. You can ask us to delete them at any time
  • Renders served from a custom domain are not on the 7 day schedule for as long as your custom domain stays connected. Some render types may still be removed sooner. If you stop using custom domains, these renders may be removed later. You can ask us to delete them at any time
  • Video outputs are not deleted on a schedule, and no automatic time limit applies. You can ask us to delete them at any time
  • You may ask us to delete any of your stored files at any time

13. Dispute Resolution

13.1 Informal Resolution

Contact us at [email protected] first. We will respond within 30 days.

13.2 Binding Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration administered by the American Arbitration Association. The arbitration will be conducted in English. Seat of arbitration: Albuquerque, New Mexico, USA.

13.3 Class Action Waiver

You and SudoMock agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

13.4 Governing Law

These Terms are governed by the laws of the State of New Mexico, United States.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and SudoMock.

14.2 Severability

If any provision is found unenforceable, the remaining provisions continue in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision does not waive it.

14.4 Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

14.5 Force Majeure

Neither party is liable for delays due to causes beyond reasonable control, including acts of God, war, natural disasters, pandemics, internet outages, or third-party infrastructure failures.

14.6 Notices

Legal notices to SudoMock must be sent to [email protected]. Notices to you will be sent to your account email.

15. Changes to Terms

We may modify these Terms. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance.
